What Legal Documents Do I Need to Have in Place?

In addition to a Will or Trust, you need:

• Durable Power Of Attorney For Health Care – Appoints someone you trust to make health care decisions for you when you cannot make them for yourself.

• Durable General Power Of Attorney For Financial Affairs – Allows someone of your choosing to make financial decisions for you if you are no longer capable of doing it for yourself.

• Guardianship Protection – A guardian is a person who has the legal authority (and the corresponding duty) to care for the personal and property interests of another person.

• Directive to Physicians (Living Will) – A Living Will usually covers specific directives as to the course of treatment to be taken by caregivers or, in some cases forbidding treatment, even food and water. This document will usually cover your desires concerning life-sustaining treatment, terminal conditions and irreversible conditions.

• HIPAA Form (Health Insurance Portability & Accountability Act)- An authorization for disclosure of confidential health care information for those you trust.
